{"id":356,"date":"2013-10-21T17:20:47","date_gmt":"2013-10-21T15:20:47","guid":{"rendered":"http:\/\/renovables.tulider.net\/?p=356"},"modified":"2013-10-21T17:20:47","modified_gmt":"2013-10-21T15:20:47","slug":"legalmente-puede-el-tasazo-a-la-fotovoltaica-del-7-afectar-negativamente-a-la-rentabilidad-de-mi-instalacion-fotovoltaica","status":"publish","type":"post","link":"https:\/\/renovables.tulider.net\/en\/legalmente-puede-el-tasazo-a-la-fotovoltaica-del-7-afectar-negativamente-a-la-rentabilidad-de-mi-instalacion-fotovoltaica\/","title":{"rendered":"\u00bfLegalmente, puede el tasazo a la fotovoltaica del 7% afectar negativamente a la rentabilidad de mi instalaci\u00f3n fotovoltaica?"},"content":{"rendered":"<p>[rax-google-adsense-3]<\/p>\n<blockquote><p><span style=\"color: #0000ff;\">Seg\u00fan el Ministerio de Econom\u00eda y Competitividad el impuesto sobre el valor de la producci\u00f3n de energ\u00eda el\u00e9ctrica del 7 por ciento no reducir\u00e1 la cifra de negocios, debiendo registrarse como un gasto en la cuenta de p\u00e9rdidas y ganancias.<\/span><\/p><\/blockquote>\n<p><span style=\"color: #0000ff;\">Tras promulgarse en el BOE la\u00a0<a href=\"http:\/\/www.suelosolar.es\/newsolares\/newsol.asp?id=7508\"><span style=\"color: #0000ff;\">Ley 15\/2012, de 27 de diciembre, de medidas fiscales para la sostenibilidad energ\u00e9tica<\/span><\/a>, con un nuevo impuesto retroactivo para la producci\u00f3n fotovoltaica del 7%, se ha remitido Consulta vinculante al Instituto de Contabilidad y Auditor\u00eda de Cuentas, dependiente del Ministerio de Econom\u00eda y Competitividad, para conocer el tratamiento contable del impuesto del 7% del valor de la producci\u00f3n de energ\u00eda el\u00e9ctrica.<\/span><\/p>\n<p><span style=\"color: #0000ff;\">La respuesta ha sido la siguiente:<\/span><br \/>\n<img data-recalc-dims=\"1\" decoding=\"async\" alt=\"\" src=\"https:\/\/i0.wp.com\/www.suelosolar.es\/images\/consultahacienda_opt.jpg?w=1200\" \/><br \/>\n<span style=\"color: #0000ff;\">Lo interesante de la respuesta es que al ser considerado un \u201c<span style=\"text-decoration: underline;\">Gasto de Explotaci\u00f3n\u201d y \u201cun tributo de car\u00e1cter directo y naturaleza real que grava la realizaci\u00f3n de actividades de producci\u00f3n de energ\u00eda el\u00e9ctrica<\/span>\u201d tiene que considerarse como un coste que \u201cresponde exclusivamente a la actividad de producci\u00f3n de energ\u00eda el\u00e9ctrica\u201d, por lo tanto\u00a0tiene que ser contemplado en el c\u00e1lculo de la \u201cretribuci\u00f3n especifica\u201d como coste est\u00e1ndar de explotaci\u00f3n a la hora de aplicar la \u201crentabilidad razonable\u201d, que recoge el apartado 4 del art\u00edculo 30 de la<a href=\"http:\/\/www.suelosolar.es\/newsolares\/newsol.asp?id=325\"><span style=\"color: #0000ff;\">\u00a0Ley 54\/1997 del sector el\u00e9ctrico<\/span><\/a>, cuyo valor para una instalaci\u00f3n tipo esta pendiente de determinar por las consultoras contratadas.
